ORDINANCE NO. 3689
AN ORDINANCE TO AMEND ORDINANCE NO. 3391 OF THE CITY OF BESSEMER, ALABAMA, KNOWN AS THE “CITY OF BESSEMER ZONING ORDINANCE,” TO AMEND SECTION 6.1, SUBSECTION (2), TO INCLUDE DATA CENTERS AS A PERMITTED USE IN THE LIGHT INDUSTRIAL DISTRICT
WHEREAS, pursuant to Sections 11-52-77 and 11-52-78 of the Code of Alabama, the Planning and Zoning Commission of the City of Bessemer, Alabama, has reviewed Section 6.1 of Ordinance No. 3391 to consider amending Subsection (2), “Permitted Uses,” to include Data Centers as a permitted use in the Light Industrial District; and
WHEREAS, a public hearing was duly scheduled and held before the Planning and Zoning Commission in accordance with the procedures and notice requirements set forth in Ordinance No. 3391; and
WHEREAS, following the public hearing, the Planning and Zoning Commission submitted a report and recommendation to the City Council of the City of Bessemer in favor of amending Section 6.1, Subsection (2), permitted uses of Ordinance No. 3391 to include “Data Centers” as a permitted use; and
WHEREAS, the City Council of the City of Bessemer has determined that it is in the public interest to consider the proposed zoning text amendment and has scheduled a public hearing for October 7, 2025, at 6:00 p.m., in the Council Chambers at Bessemer City Hall, 1700 Third Avenue North, Bessemer, Alabama, and has directed the City Clerk to provide notice of said hearing as required by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BESSEMER, ALABAMA, AS FOLLOWS:
Section 1. Section 6.1, Subsection (2), “Permitted Uses,” of Ordinance No. 3391, as previously adopted and amended, is hereby further amended to include “Data Centers” as a permitted use in the Light Industrial (I-1) District.
Section 2. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed.
Section 3. This Ordinance shall become effective immediately upon its adoption and publication as required by law.

AN ORDINANCE ADOPTING THE GENERAL FUND BUDGET OF THE CITY OF BESSEMER, ALABAMA FOR FISCAL YEAR 2025-2026 FOR THE PERIOD BEGINNING OCTOBER 1, 2025, AND ENDING SEPTEMBER 30, 2026; AND REPEALING AND RESCINDING ALL RESOLUTIONS AND ORDINANCES OR RESOLUTIONS OF APPROPRIATION IN CONFLICT HEREWITH AND NOT OTHERWISE SAVED FROM LAPSE.
WHEREAS, the governing body of the City of Bessemer, Alabama, has adopted ordinances to carry over the General Fund Budget for the City of Bessemer for the Fiscal Year beginning October 1, 2024, and ending September 30, 2025, as the General Fund Budget for a limited period to November 4, 2025; and
WHEREAS, after reviewing the proposed budget submitted by the Mayor for Fiscal Year 2025-2026 and having made certain revisions thereto, the governing body now desires to adopt said budget as the General Fund Budget of the City of Bessemer, Alabama; and
WHEREAS, it is the desire and intent of the governing body of the City of Bessemer that all sums expended by the City pursuant to the carryover and interim measures shall be assigned to appropriate line items in the General Fund Budget for Fiscal Year 2025-2026 and said expenditures shall be deducted from the line-item appropriations; and
WHEREAS, it is the desire and intent of the governing body of the City of Bessemer to closely monitor the appropriations contained in the budget as changed and revised and to make necessary adjustments in spending as revenue dictates.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BESSEMER, ALABAMA, AS FOLLOWS:
Section 1. The general income and receipts of the City of Bessemer, Alabama for Fiscal Year 2025-2026 is estimated to be in the amount of $78,172,721.01.
Section 2. The amount herein is appropriated and allocated in the General Fund Budget of the City of Bessemer, Alabama for Fiscal Year 2025-2026, as provided in Exhibit “A”, is $78,172,721.01.
Section 3. The General Fund Budget for Fiscal Year 2025-2026 authorizes a two percent (2%) cost of living pay increase for all employees of the City of Bessemer to be effective November 1, 2025.
Section 4. Any portion of an appropriation remaining unexpended and unencumbered at the close of the fiscal year not specifically saved by an anti-lapse provision shall lapse.
Section 5. No payment shall be made and no obligation incurred against the general funds of the City of Bessemer by or on behalf of the City except in accordance with an appropriation duly made by this Ordinance or an amendment hereof, and no payment shall be made from or obligation incurred against any allotment or appropriation unless the City Finance Director shall first certify that there is a sufficient unexpended and unencumbered balance in such allotment or appropriation to meet the same.
Section 6. Every expenditure or obligation authorized or incurred in violation of the provisions of this Ordinance and every payment made in violation of the provisions of this Ordinance shall be deemed unauthorized. Every payment made in violation of the provisions of this Ordinance shall be deemed illegal, and every official who shall knowingly authorize or make such payment or knowingly take part therein and every person who shall knowingly receive said payment or any part thereof shall be jointly and severally liable to the City for the full amount so paid or received.
Section 7. The City Clerk of the City of Bessemer is hereby authorized and requested to forward a copy of this ordinance to the Director of the Personnel Board of Jefferson County, Alabama.
Section 8. This budget shall become effective immediately upon its adoption as required by law.
