A 2.00% DBE Contract Obligation Is Required.

This ordinance for the levy of a revised service charge on business units is in addition to any and all ordinances currently in effect for service charges levied by the Board. All provisions of the current service charge ordinance shall apply to this ordinance as to definitions, levy, collection, exemption, due date, delinquency, and enforcement of the service charge herein.

Section 4. Schedule of Service Charges:

  • Business Units: The service charge for each business or mini-warehouse facility, as approved by the Board at their sole discretion, shall be 13 mils of its current assessed value.

All other provisions of Section 4 shall remain unchanged and in full force and effect. This ordinance shall become effective after eight days have elapsed following the publication in a newspaper of general circulation and posting of notice in each fire station, or as otherwise provided by law pursuant to Section 13 of Act No. 79 of the Special Session of the Legislature of Alabama 1966, as amended, and shall remain in effect for subsequent service charge years until repealed or amended by the Board of Trustees of the District.

WHEREAS, pursuant to Sections 11-52-77 and 11-52-78 of the Code of Alabama, the Planning and Zoning Commission of the City of Bessemer, Alabama, has reviewed Section 6.1 of Ordinance No. 3391 to consider amending Subsection (2), “Permitted Uses,” to include Data Centers as a permitted use in the Light Industrial District; and

WHEREAS, a public hearing was duly scheduled and held before the Planning and Zoning Commission in accordance with the procedures and notice requirements set forth in Ordinance No. 3391; and

WHEREAS, following the public hearing, the Planning and Zoning Commission submitted a report and recommendation to the City Council of the City of Bessemer in favor of amending Section 6.1, Subsection (2), permitted uses of Ordinance No. 3391 to include “Data Centers” as a permitted use; and

WHEREAS, the City Council of the City of Bessemer has determined that it is in the public interest to consider the proposed zoning text amendment and has scheduled a public hearing for October 7, 2025, at 6:00 p.m., in the Council Chambers at Bessemer City Hall, 1700 Third Avenue North, Bessemer, Alabama, and has directed the City Clerk to provide notice of said hearing as required by law.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BESSEMER, ALABAMA, AS FOLLOWS:
